Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the purchase of products from SWEEZY ("We", "Us", "Seller") through our e-commerce website at sweezy.shop ("Website", "E-shop").

By placing an order, you ("Customer", "Buyer") agree to be bound by these Terms.

All information about the processing of your personal data is contained in our Privacy Policy.

2. Definitions

  • Price: The financial amount you pay for the Products
  • Shipping Cost: The financial amount you pay for delivery of Products, including packaging
  • Total Price: The sum of Price and Shipping Cost
  • Invoice: Tax document issued for the Total Price
  • Order: Your binding proposal to purchase Products from Us
  • Products: All items available for purchase in the E-shop

3. Order Process

The contract is concluded remotely through the E-shop. You bear the costs of using remote communication means (such as internet access), but these costs do not differ from standard rates.

To place an Order, you must provide the following information on the Website:

  • Information about the Products you wish to purchase (click "Add to Cart")
  • Price, Shipping Cost, payment method, and preferred delivery method
  • Your identification and contact details: name, surname, delivery address, phone number, and email address

Before completing your Order, you can review and modify the information. After clicking "CONTINUE TO PAYMENT", you must confirm that you have read and agree to these Terms. Without this confirmation, you cannot complete the Order.

We will confirm your Order as soon as possible by email. The confirmation will include a summary of your Order and these Terms. The contract is concluded when we send you the Order confirmation.

We may be unable to confirm your Order in certain cases, such as when Products are unavailable or when you order more items than available. We will contact you and offer a modified contract proposal. The contract is concluded when you confirm our proposal.

If an obviously incorrect Price is displayed on the Website or in the Order, we are not obligated to deliver the Products at that Price, even if you received an Order confirmation. We will contact you and offer a new contract proposal at the correct Price.

4. Prices and Payment

Prices are always displayed on the Website, in the Order proposal, and in the contract. In case of discrepancy, the Price in the Order proposal applies.

The Total Price is stated in Czech Crowns (CZK) or Euros (EUR), including all legally required fees. We are not VAT payers according to applicable tax legislation.

Payment is required after the contract is concluded and before Product delivery. You can pay using:

  • Credit/Debit Card Online: Payment processed through Stripe payment gateway. Payment is due immediately upon order completion.
  • Bank Transfer: Payment instructions will be sent in the Order confirmation. Payment is due within 5 business days.

The invoice will be issued electronically after payment and sent to your email address.

Ownership: Ownership of Products transfers to you after you pay the Total Price and receive the Products. For bank transfers, payment is complete when funds are credited to our account.

5. Delivery

Products will be delivered within 20 days using your chosen delivery method:

  • Pickup at Packeta/Zásilkovna pickup points
  • Delivery to your address via Packeta/Zásilkovna

Products can be delivered within the Czech Republic and Slovakia.

Delivery time depends on Product availability and your chosen delivery and payment methods. The expected delivery time will be provided in the Order confirmation. Products are usually shipped within 3-5 business days after payment receipt.

Free Shipping: Orders over 2,000 CZK qualify for free shipping.

Upon receiving Products from the carrier, you must check the package for damage. If the package shows signs of unauthorized tampering, immediately notify the carrier and us. You are not required to accept damaged packages.

If you fail to accept the Products (except in cases mentioned above), this does not constitute breach of our delivery obligation. However, it is not considered cancellation of the contract. We have the right to withdraw from the contract due to your substantial breach or store the Products at your expense.

If Products must be delivered repeatedly or differently than agreed due to reasons on your side, you must reimburse us for the additional costs.

Risk of Loss: Risk of loss or damage to Products transfers to you when you receive them. If you fail to accept Products (except in cases mentioned above), risk transfers when you had the opportunity to receive them.

6. Right of Withdrawal (for Consumers)

If you are a consumer (purchasing outside your business activities), you have the right to withdraw from the contract without reason within 14 days from receipt of the Products.

You can withdraw by any verifiable method (email or mail to our contact addresses). You may use the withdrawal form provided below.

The withdrawal period is considered met if you send us notice of withdrawal before the period expires.

Exceptions: You cannot withdraw from the contract for:

  • Products made to your specifications or personalized
  • Perishable products or products past their expiration date

Upon withdrawal, you must return Products within 14 days and bear the return costs. You are entitled to a refund of the Shipping Cost, but only up to the amount of the cheapest delivery method we offered.

We will refund the Price within 14 days of withdrawal to the account from which payment was made or an account you specify. However, we will not refund until we receive the Products or you prove they were sent back.

Please return Products clean and, if possible, in original packaging. You are responsible for any decrease in Product value resulting from handling beyond what is necessary to establish the nature, characteristics, and functionality of the Products.

7. Warranty and Complaints

We guarantee that Products are free from defects at the time of delivery, specifically that Products:

  • Correspond to the agreed description, type, quantity, quality, functionality, and other agreed properties
  • Are suitable for the purpose you require and which we have agreed to
  • Are delivered with agreed accessories and instructions for use
  • Are suitable for the purpose for which Products of this type are normally used
  • Correspond in quality and other characteristics to what you can reasonably expect
  • Are delivered with accessories, including packaging and instructions, that you can reasonably expect

If Products have defects, you can notify us and file a complaint by email or mail to our contact addresses. You may use the complaint form provided below. In your complaint, specify how you want the defect resolved. You cannot change this choice without our consent.

If Products have defects, you have the following rights:

  • Delivery of new Products without defects, or delivery of missing parts
  • Repair of the Products

However, we may refuse to remedy the defect if it is impossible or disproportionately costly.

Additionally, you have the right to:

  • A reasonable discount from the Price; or
  • Withdraw from the contract

If:

  • We refuse to remedy the defect or fail to do so in accordance with legal requirements
  • The defect occurs repeatedly
  • The defect constitutes a substantial breach of contract
  • It is clear from our statement or circumstances that the defect will not be remedied in a reasonable time or without significant inconvenience to you

You do not have the right to withdraw from the contract if the defect is insignificant.

We will issue a written confirmation of your complaint, including:

  • Date of complaint
  • Content of complaint
  • Desired method of resolution
  • Your contact details for notification of resolution

Unless we agree on a longer period, we will remedy defects within 30 days of receiving the complaint and notify you of the resolution. If this period expires without resolution, you may withdraw from the contract or request a reasonable discount.

If the complaint is justified, you are entitled to reimbursement of reasonably incurred costs. You must prove these costs (e.g., receipts for shipping). If the remedy involves delivering new Products, you must return the original Products at our expense.

Warranty Period for Consumers: If you are a consumer, you have the right to assert warranty claims for defects that appear within 24 months from receipt of the Products.

Business Customers: If you are a business customer, you must notify and specify defects without delay after you could have discovered them, but no later than 3 days from receipt of the Products.

8. Personal Data Protection

Protection of your personal data is governed by our separate Privacy Policy.

9. Dispute Resolution

We are not bound by any codes of conduct regarding consumer relations.

We handle consumer complaints via email at support@sweezy.shop. Information about complaint resolution will be sent to your email address.

10. Final Provisions

If our relationship contains an international element (e.g., we ship products outside the Czech Republic), the relationship will always be governed by Czech law. However, if you are a consumer, this agreement does not affect your rights arising from legal regulations of your country.

We will deliver all written correspondence to you electronically. Our email address is listed in our contact information. We will send correspondence to your email address provided in the contract or through which you contacted us.

The contract can only be modified by our written agreement. However, we are entitled to change and supplement these Terms. This change will not affect already concluded contracts, only contracts concluded after the change takes effect. We will inform you of changes by publishing them on this page with the date of the last update.

In case of force majeure or unforeseeable events (natural disasters, pandemics, operational failures, supplier outages, etc.), we are not responsible for damages caused by or in connection with force majeure. If force majeure lasts longer than 10 days, both we and you have the right to withdraw from the contract.

The contract, including these Terms, is archived electronically by us but is not accessible to you. However, you will always receive these Terms and Order confirmation with Order summary by email, so you will have access to the contract without our assistance. We recommend saving the Order confirmation and Terms.

If any provision of these Terms is invalid or ineffective, it does not affect the validity of other provisions.
